Agreement to Terms
By downloading, installing, or using the Swinglio Golf application ("App") and related services ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
"Swinglio," "we," "us," and "our" refer to Swinglio Golf and its operators. "You" and "your" refer to the individual using the Service.
Eligibility
You must be at least 13 years old to use Swinglio. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.
Account Registration
To access certain features, you must create an account. You agree to:
- Provide accurate and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activity that occurs under your account
Subscriptions and Payments
Free Tier: Swinglio offers a free tier with limited features. No payment is required for the free tier.
Pro Subscription: The Pro subscription is available at $1.99 per month or $19.99 per year (or the current listed price at the time of purchase). Subscriptions are billed through Apple's App Store or Google Play Store and are subject to the respective store's terms and billing policies.
Cancellation: You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.
Price Changes: We reserve the right to change subscription pricing. You will be notified of any price changes before they take effect.
Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or its infrastructure
- Use automated systems to access the Service without permission
- Harass, abuse, or harm other users through social features
- Reverse engineer, decompile, or disassemble the App
Your Content
You retain ownership of the golf data, scores, and content you submit to Swinglio ("Your Content"). By submitting content, you grant us a limited, non-exclusive license to use, store, and display Your Content as necessary to operate and provide the Service.
You are responsible for the accuracy of the scores and data you enter. We do not verify or validate golf scores for official handicap purposes.
Intellectual Property
The Swinglio app, including its design, code, graphics, logos, and trademarks, is owned by Swinglio Golf and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our written permission.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
Swinglio is not an official handicap tracking service. Scores and statistics provided by the app are for personal reference and entertainment purposes only.
Limitation of Liability
To the maximum extent permitted by law, Swinglio Golf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, arising from your use of or inability to use the Service.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request export of your data before account deletion.
Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the App or via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
Dispute Resolution
If you have a dispute with us, you agree to first contact us at support@swinglio.com and attempt to resolve the dispute informally for at least 30 days. If the dispute is not resolved informally, both parties agree to resolve any claims through binding arbitration on an individual basis, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
Exceptions: Either party may bring claims in small claims court if eligible.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions.
